Terms of Use

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Site or place an order. By using the Site, you represent and warrant that you meet these requirements.

2. Your Account

You may browse the Site as a guest or create an account. When you create an account, you agree to provide accurate, current, and complete information and to keep your account credentials confidential. 3. Products and Availability

All products are subject to availability. We may limit the quantities of any product, discontinue products, or modify product descriptions at any time without notice. Product images are for illustration; actual products may vary slightly in appearance.

Our products are baked goods that may contain or be produced in a facility that processes wheat, dairy, eggs, soy, tree nuts, peanuts, and other allergens. Allergen and ingredient information is provided on the Site for your reference but is not a substitute for professional medical advice. If you have a food allergy or dietary restriction, please consult the product page carefully or contact us before ordering.

4. Orders and Order Acceptance

When you place an order, you are making an offer to purchase the products at the prices and terms shown. Your order is not accepted until we send you an order confirmation by email. We reserve the right, at our sole discretion, to refuse, cancel, or limit any order at any time, including after an order has been confirmed, for reasons that may include but are not limited to product unavailability, suspected fraud, errors in pricing or product information, or violations of these Terms.

5. Pricing and Pricing Errors

All prices are listed in U.S. dollars and do not include applicable taxes, shipping, or other fees, which will be added at checkout. Prices are subject to change without notice.

Pricing or product information errors. Despite our best efforts, products on the Site may occasionally be mispriced, inaccurately described, or shown with incorrect information. We reserve the right, at our sole discretion and at any time (whether before or after an order has been placed, confirmed, paid for, or shipped), to correct any such errors and to:

• Cancel the affected order in whole or in part and issue a refund for any amount already charged;
• Contact you to confirm the corrected price or details and offer you the option to proceed at the corrected terms or cancel for a full refund;
• Adjust the price or product information going forward without obligation to honor the prior, incorrect terms; or
• Resolve the issue by other reasonable means, including issuing a refund or credit at a later date once the error is identified.

Confirmation or shipment of an order does not constitute our acceptance of an incorrect price or description, and we are not obligated to provide products at an erroneous price even after payment has been processed. If an error is corrected after an order has been placed and you do not wish to proceed at the corrected terms, your sole remedy is a full refund of amounts paid for the affected items.

6. Payment

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method and authorize us, or our third-party payment processor, to charge the full amount of your order (including taxes, shipping, and any other applicable fees). If your payment cannot be processed, we may cancel your order.

7. Shipping, Delivery, and Risk of Loss

Shipping options, costs, and estimated delivery windows are shown at checkout. Delivery dates are estimates and not guarantees; actual delivery may vary based on carrier performance, weather, and other factors outside our control. Because our products are perishable, we recommend selecting a delivery date and address where someone will be available to receive the package promptly.

Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays, damage, or loss caused by the carrier, by an incorrect address provided by you, or by failure to retrieve a delivered package in a timely manner.

8. Returns, Refunds, and Order Issues

Because our products are perishable, we generally do not accept returns. If a product arrives damaged, defective, or significantly different from what was ordered, please contact us at [email protected] or (414) 543-7000 within 7 days of delivery with your order number and, where possible, photos of the issue. We will work with you to resolve the problem, which may include a replacement, store credit, or refund at our discretion.

9. Promotions, Discount Codes, and Gift Recipients

Promotional codes and discounts are subject to the terms stated at the time of the promotion. We reserve the right to limit redemptions, exclude certain products, require a minimum purchase, or terminate a promotion at any time. Discount codes have no cash value and cannot be combined unless expressly permitted.

When you ship a product as a gift, you are responsible for providing accurate recipient information and confirming that the recipient is willing to receive the shipment. We are not responsible for issues arising from incorrect recipient information or unwanted gift deliveries.

10. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to any portion of the Site, other accounts, or our systems;
• Interfere with the operation of the Site, including by introducing malware, scraping at scale, or otherwise attempting to disrupt service;
• Use any automated means (bots, scrapers, etc.) to access the Site for purposes other than standard public search-engine indexing;
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Submit false, misleading, or fraudulent information, including in connection with payment or returns.

11. Intellectual Property

The Site and all content on it (including text, graphics, logos, product names, photographs, and software) are owned by Grebe's Bakery or its licensors and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, modify, distribute, or use any of this content for commercial purposes without our prior written consent.

12. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by Grebe's. We are not responsible for the content, policies, or practices of any third-party site. Your interactions with third-party sites are at your own risk.

13. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, GREBE'S DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT PRODUCT DESCRIPTIONS OR OTHER CONTENT ARE ACCURATE, COMPLETE, OR CURRENT.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GREBE'S, ITS AFFILIATES, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED THROUGH IT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE ITEM(S) GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Grebe's, its affiliates, and its officers, directors, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

16. Termination

We may suspend or terminate your access to the Site, your account, or any order at any time, with or without notice, for any reason, including suspected violation of these Terms. Provisions of these Terms that by their nature should survive termination will so survive.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Site will be resolved in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to the personal jurisdiction of those courts.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the Terms were last revised. Material changes will be effective when posted on the Site. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms.

19. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with any other policies posted on the Site, constitute the entire agreement between you and Grebe's with respect to your use of the Site and purchases through it.
